Abstract

The main job of Syaria Council is declaring fatwa about transactions in Syariah Banking. By the time there are many sides announce to gather the fatwa into one line, Nasional Syaria Council in Indonesia declares a fatwa that contradict with fatwa from Syaria Council of Faisal Islamic Bank in Egypt about gold transaction. This case rises a question how is the method of istinbath in both councils. This reaseach uses analytical descriptive approach. The result shows that the members of syariah council in Indonesia, have argument that gold is a commodity agree with the whereas this case is contradict with Ijma.They do not support the decision of international Islamic law council. On the other hand, syariah council of Egypt support the International Islamic Law Council.
