Abstract
As the negative impact of lack of adequate understanding to the terms of syari'ah and fiqh, many people have different and contradictive extreme attitudes one another. In general, radicalism in the study of fiqh is as result of political upheavals, schools fanaticism, judiciary weakness, and fiqh codification. Therefore, to avoid stagnation and keep the law and legal science to develop, absolutely requires un-endless effort to make ulama. umara and moslem people realize and aware of the importance of the substance of fiqh
